Hello All. I am here to deliver a speech on article 370. This has been the most discussed topic in recent times. Since Independence, It gave special status to J & K. We all Indians use to subconsciously think about it, majority of us had apprehensions about it, we wanted it to be scrapped, we wanted it to get removed as it used to create discrimination between natives of J & K with rest of the Indians. Finally, it happened on 05.Aug.2019.  The government of India revoked it. Now all the Indians including J & K people are equal, all are now covered under the constitution of India. All of us now have a single nationality, single flag, and common laws.

Background of Article 370

  In 1947, when India was about to get freedom and when the British were leaving India, they give the freedom to all the kings in India to live wherever they wish to. This caused the formation of hundreds of provinces internally.

By the efforts of Sardar Vallabh Bhai Patel, all those provinces agreed to unite to form a nation. But one province i.e. Jammu & Kashmir, which was ruled by the then king Hari Singh, was not ready to get united.

They did not want to get merged & wanted to maintain their identity as an independent province. Pakistan tried to acquire Kashmir forcefully by invading its forces in it in October 1947. Hari Singh asked India for help in fighting with the Pakistani army.

India did help under once condition that Kashmir needs to come with India. India did promise to give it a special status under Article 370 of the constitution of India.

Benefits and Drawbacks of Article 370

People in Jammu and Kashmir had dual citizenship, which is the citizenship of J & K as well as India. They had a different flag. The elections were conducted every 6 years in J & K. Criticising the Indian flag was not a crime in J & K. The rules of the Supreme court of India were not applicable to J&K.

If a Kashmiri girl married any man outside J&K, she lost her J&K citizenship. And if she married any Pakistani, then that man used to get J&K citizenship. The RTI act was not applicable to J&K. No reservations for minorities were there in J&K. No one outside J&K could buy land over there. Financial emergencies were not applicable to J&K.

Kashmir never faced the problem of over crowing or overpopulation, as no one from outside can get and settle into J&K. Employment opportunities were very low in J&K, and hence a lot of youth were heading towards terrorism.

Low GDP was there and corruption was very high. After independence, China had acquired 10% of Kashmir & Pakistan had acquired 30% of Kashmir. India has only 60% of Kashmir left with it. Article 370 was implemented as a temporary provision, that’s why India could scrap it, and hence could finally unify J&K with all the states.

Revocation of article 370  will have a positive impact. It can have many benefits, both to J&K people as well as to the rest of the Indians. J&K people will now have ample career opportunities. The business opportunities will increase. J&K girls can now freely marry to anyone in India. Their GDP will increase.

Other states people can now invest in J&K. They can set up manufacturing units, hence increasing job opportunities to J&K people.  Foreign investors were also eyeing on the scrapping of article 370, hence we can expect the increase in FDI in J&K. Let us all wish our India to be strongly unified & flourish.

Speech on Article 370: Article 370 of the Indian constitution offers special powers to J&K. The land in J&K is widely disputed; therefore, special provisions were created. On August 5th, 20219, a landmark judgement was passed for the abrogation of Article 370. This led to the division of J&K into two separate states- J&K and Ladakh regions.

A warm welcome to everyone present here. Today I am here to share my thoughts on Article 370. It is one of the most discussed topics nowadays. Article 370 acknowledges the special status of Jammu & Kashmir, which is different from the rest of the residents of Indians. It always created discrimination between the residents of Jammu & Kashmir & rest of the Indians. It came into force in 1949.

Let me throw some knowledge on the history of the same. Back in 1947 when India got independence from the Britishers, Jammu & Kashmir was a princely state which did not agree to unite with India. Hari Singh then ruled the province. But soon after independence in October 1947, Pakistan tried to attack Jammu & Kashmir to acquire it fully. Hari Singh then asked India help to fight with the Pakistan Army.

India did help under the condition that it will come along & unite with India. India promised to give it a special status under Article 370 of the constitution. Since then, Jammu & Kashmir has been the subject of the clash between India & Pakistan for the full control of the territory. India & Pakistan subsequently went into several wars, with which each came to control different parts of the territory with a ceasefire line agreed.

Now let me tell you how this special status impacted people? All the provisions which were applicable for all other states of India were not applicable for Jammu & Kashmir until & unless it has been passed in the state assembly. This was applicable for all the laws except for defence, foreign affairs, finance & communication. The people of J & K live under a different set of laws regarding citizenship, property & fundamental rights.

The residents were given dual citizenship. The election was conducted at an interval of every six years, not in five years. Many more other laws were different from the rest of the country. Now Article 370 also had drawbacks. No one from outside the state can settle there, so which resulted in deficient job creation—several other problems like corruption, slower economic growth & many more.

Article 370 was a temporary provision & on 5th August 2019 government of India revoked it. Repealing of Article 370 has given equal opportunity to the residents of Jammu & Kashmir as other citizens of India. Now all the measures can be taken to improve the economic status of Jammu & Kashmir. It is now part of India without under any special provision; it is same as all the other states. We all have the same nationality, same law & rights. We all are proud to be Indians.

Speech on Article 370: Did you know people of the Indian State of Jammu and Kashmir had dual citizenship: citizenship of Jammu and Kashmir and India? In August 2019, the Indian Government issued a Presidential order to remove Article 370 from the Indian State of Jammu & Kashmir, after which the Jammu and Kashmir Reorganisation Act, 2019 was passed by the Parliament. This act converted the entire state into two different Union Territories: Jammu and Kashmir and Ladakh. This order was passed by a two-thirds majority vote in both the houses of the Indian Parliament: Lok Sabha and Rajya Sabha.

This act revoked the special status of the Indian State of Jammu & Kashmir, which had the special status under Article 370 . There were nationwide debates on this decision, where people were challenging the government’s decision. The Government, on the other hand, proclaimed that it was necessary to maintain peace in the valley and for the complete inclusion of the entire region. ‘Good morning, my teacher (s) and dear friend. Today, I stand before you to present my speech on Article 370. Our Constitution gave a special status to the Indian State of Jammu and Kashmir under Article 370. This status was given because this area has been the subject of a dispute between India and Pakistan on one side and India and China on the other.

In 1948, right after Independence, there was a territorial dispute between India and Pakistan, where the latter claimed Kashmir as its integral part. After this, on 17th October 1949, the Indian Government passed the Article 370 Act. Jammu and Kashmir’s accession happened on three matters: Defence, foreign affairs, and communications.

‘However, Kashmir became the frontline warzone, because of which there has been a series of wars between India and Pakistan – 1947, 1965, and 1971 and a war-like situation erupted in 1998 as well (Kargil war).’

‘To give a new life to the people of Jammu and Kashmir and make it a terror-free region, the Indian Government removed Article 370. In India, we have a federal structure, with three different lists; Union, State, and Concurrent Lists. In the case of Jammu and Kashmir, only the State List was applicable, and subjects under the Union and Concurrent lists were limited. It means the residual powers were not in the hands of the Union but in the hands of the State.’

When Article 370 was implemented, only two articles of the Indian Constitution applied in full to Jammu and Kashmir. Now, with the removal of Article 370, this entire region is directly governed by the central government, which has appointed a Lieutenant Governor in both regions.’

‘We are the largest democracy in the world, and it is our constitutional right to question the government’s decision. However, Article 370 is a sensitive topic and the government knows what’s best for the country and its people. Therefore, we must understand why the government removed Article 370.

What Are the Advantages and Disadvantages of Article 370?

Like any other law, Article 370 also has two different sides: advantages and disadvantages. Below we discussed some of the popular advantages and disadvantages of Article 370.

Advantages of Article 370

  • Article 370 was implemented for the complete inclusion of J&K in India.
  • It prompts the slogan ‘One Nation, One Constitution.’
  • Private investors can invest and take land on lease, which will contribute to the region’s economy and create employment opportunities.
  • J&K will be part of India, just like any other state or union territory.

Disadvantages of Article 370

  • A person living outside J&K is not allowed to buy land in the valley.

Good Morning everyone! Good to see you all! I am ________ from class/dept __________, here to give a speech on one of the most talked about topics in India, today – Article 370. For those who don’t know about Article 370 and its origin, I am pleased to remind that, it was Article especially enshrined in the Constitution of India for the state of Jammu and Kashmir. But, there was an exception, while all the parts of the Constitution were uniformly applicable to all the states and union territories of India; Article 370 provided a kind of immunity or special status to the state of Jammu and Kashmir.

That is, Legislative powers of centre over the state of Jammu and Kashmir were limited only on vital matters of foreign affairs, defence, communication etc. This gave the J&K Legislative Assembly draconian powers to rule over the state. However, you all must be aware that Article 370 has been abrogated with effect from 5 th August 2019, by a Presidential order. Clause (3) of Article 370 empowers the President of India to make amendments and change the scope of the Article. This very clause was used by the present NDA led government at centre in abolition of Article 370. Apart from abrogation of Article 370, the government also successfully passed the bill for reorganization of J&K and Laddakh in both the houses of Parliament.

Now, J&K is a Union Territory with Legislative Assembly and Laddakh will also be a Union Territory without Legislative Assembly. The abolition of Article 370 will, in the long run, have significant political, economical and social consequences on the state of J&K and its people. The state which has been reeling under terrorism and cross border insurgency since independence is now expected to get a new lease of life with full legislative power of the government. By and large, the decision will benefit the development of the state and expose the youths to new arenas of growth and prosperity. In my opinion the abolition of Article will start new business ventures in state, and encourage new start ups.

In the coming years sectors like education, healthcare, tourism & hospitality are going to grow at a tremendous pace, generating employment and improving economy. All in all this is a good action by the government taken in a good spirit for the benefit of the people of Jammu & Kashmir. The move got a huge support from Indian masses and political parties as well. Almost all the political parties of India, big or small, supported the move; though, there were few exceptions also. Opinion of the senior congress leadership is however divided over the issue. Scrapping of Article 370 from J&K didn’t evoke much response from the international community, as no international treaty of commitment was violated.

However, Pakistan is crying foul and terms the move as unilateral, biased and unconstitutional. Present Prime Minister of Pakistan has also indicated on taking the matter to the United Nations; though, there too, lies little hope as no international violation has been made by India. With this, I would like to end my speech on Article 370 and hope that the people of Jammu and Kashmir and Laddakh, will soon be on the path of growth and development as rest of the nation is. A very Good Morning to all those present here. I am ________ from __________, here to talk to you and share views on Article 370. Article 370 of the Indian Constitution provided a special status to the state of Jammu and Kashmir. J&K was allowed to have its own Constitution and rendered the Constitution of India in applicable in the state. The Article also gave the local leadership of J&K, superiority over Centre to rule the state at its own will. It also gave the government of Jammu and Kashmir, the power to decide the citizenship and its rights.

The Article 370 was instituted in the Constitution of India in 1949 as a Temporary, Transitional and Special provision. All of you must have got the news, nevertheless, it’s my duty to remind you all, that Article 370 has been scrapped by the BJP led NDA alliance at the centre. This had been possible by passing a Presidential order, abrogating Article 370 from J&K. Clause 3, of the Article 370 itself mentions that the President of the Indian Union is empowered to make necessary changes into the Article or to abolish it right away. Overall it is a good move by the government of India and I have arguments to support my opinion.

Till now Jammu and Kashmir, had its own Constitution and flag, moreover, any disrespect to Indian national flag wasn’t a crime under law. But, now with Article 370 scrapped no one would dare to burn or malign the Tricolor in any way. The Article also gave dual citizenship to the residents of J&K, that is every resident of J&K was also a resident of India; on the other hand, residents of other parts of India were not considered as residents of J&K. This divisive law of citizenship now stands abolished.

Certain clauses of the Article were also gender discriminatory. For example, if a permanent male resident of J&M marries a woman from some other part of India, then his rights over the land won’t change and both the husband and wife were natural owners of the land. On the contrary, if a woman resident of J&K Kashmir marries an outsider, then she automatically loses all of her property rights, what so ever, in the state. This biased law now stands abolished. Indian citizens were not allowed to buy property in Jammu and Kashmir, a law which made establishment of small businesses difficult and hampered the overall economical growth of the state.

But, now the state is open to small and large business houses for investment in education, healthcare, tourism, infrastructure etc, ultimately generating employment and boosting economy. The abrogation is also expected to improve India’s preparedness against terrorism and cross border infringement. It gives free hand to the Indian government like all other parts of India on vital issues of state’s concern. The move is supported hugely by Indian citizens and also politicians, across the party lines; however, some leaders seem to differ.

Among those who are condemning the act as unconstitutional and aggressive are – J&K National Conference chief, Farooq Abdullah and People Democratic Party (PDP) member, Mahbooba Mufti. Apart from facing opposition from certain political class and extremists groups, the move, by and large, enjoys tremendous support of the people of India. Neighboring Pakistan, (which had been till now misusing the special status of J&K for its own interest, to support infiltration and terrorism in India) is the only country which is voicing some opposition.

Government of Pakistan is contemplating about raising the issue with international community in the United Nations. With no response from the international community on scrapping of Article 370, mainly because it didn’t violate any international treaty, leaves Pakistan with less hope of having a desirable outcome. However difficult the decision to abolish Article 370 might have been, it was possible only by an unwavering political will and impeccable plan of action.

Let us hope that the action will bring peace in the valley which has long been suffering with terrorism and insurgency. Let us hope that new educational institutions, professional institutes, hospitals, hotels, restaurants, factories etc will be open in J&K, putting the state on the tracks of growth and prosperity and to revive its economy. The opposition benches protested against this resolution; however, the decision has been made. Revoking Article 370 of the Indian Constitution had been a major part of BJP’s agenda. Shah’s announcement was thus received with elation by the BJP leaders.

Mixed Reactions on Revocation of Article 370

While many political parties opposed the decision to scrap Article 370 of the Indian Constitution, several others extended their support to the BJP government.

Parties that Supported the Decision

Among those that showed support to this decision were the Aam Aadmi Party,   Bahujan Samaj Party, Shiv Sena, AIADMK, Shiromani Akali Dal, YSR Congress, Telugu Desam Party, Biju Janata Dal, BPF and AGP. All these parties backed the Centre’s decision.

Many of them mentioned that they awaited this move since long and welcome the decision wholeheartedly. They now look forward to peace and development in J&K. The decision of scrapping Article 370 has been termed as bold and courageous.

BSP member, Satish Chandra Misra was among the first ones in the Rajya Sabha to support this move. Mayawati also extended support to the bifurcation of Jammu and Kashmir.

AIADMK mentioned that their leader, Jayalalithaa had always wanted this. Shiv Sena members expressed their joy and support by celebrating outside their party head office.

BJD members said that with this decision, Jammu and Kashmir has become an integral part of the country and they are glad about it.

Parties that Opposed the Decision

The parties those opposed the Centre’s decision to revoke Article 370 include Congress, Trinamool Congress, Nationalist Congress Party, Janata Dal (United), Rashtriya Janta Dal, Left, National Conference, DMK and People’s Democratic Party. All these parties condemned and criticised the resolution.

Congress members mentioned that this was a “catastrophic step” and it should be seen as a “black day” in the constitutional history of our country. It further said that this decision is a publicity stunt by BJP to fetch more votes. Likewise, Left mentioned that it is an attack on the Indian Constitution.

Members of People’s Democratic Party expressed their anger over the decision by shouting slogans and tearing copies of Indian Constitution. National Conference called the decision shocking and unilateral. Trinamool Congress also expressed its objection against the Centre’s decision.

DMK went on to say that this was simply the murder of democracy. It said that BJP is forcing its agenda and that it has no respect for the sentiments of the Jammu and Kashmir residents.

Revocation of Article 370 of the Indian Constitution is indeed a big decision. A major change in J&K is likely underway now. We hope things change for good for this beautiful state which has long struggled for peace and justice. Respected Principal, teachers and my dear friends, a wonderful morning to all of you. Today on this special occasion, I would like to speak some words on the topic- Article 370.

Article 370 was an article of the Indian constitution that granted special status to the state of Jammu and Kashmir. It allowed Jammu and Kashmir to have a separate constitution and autonomous administration, exempt from the laws of the Indian state.

The article was issued by the Indian government when India went to war with Pakistan over Jammu and Kashmir due to territorial disputes after independence. In 2019, Article 370 was repealed, making the Constitution of India applicable to the state of Jammu and Kashmir too. In addition, it was decided that the state would be partitioned into two union territories- Jammu and Kashmir, and Ladakh.

Speech On Article 370:  Indian Constitution’s Article 370 involves giving special status to Jammu and Kashmir (a region located in the northern part of the country), which was administered by India from 1954 and was the reason of dispute between India, Pakistan and China for a long time.

Article 370 along with Article 35A provided special treatment to the residents of the state of J&K, under a separate set of laws including those for citizenship, fundamental rights, ownership of property etc. under this Article Indians from any other state could not purchase land or own any property in Kashmir.

However, on August 5th 2019, the Government announced the abrogation of Article 370 along with 35A. This meant that the state was now divided into two territories of J&K (with a legislature) and Ladakh (without any legislature).

A very good morning/ afternoon/ evening to one and all present here.

Today we have all gathered here to discuss an important topic which has been talked over by many in the recent past, due to the changes brought up by the Government. I will be talking about Article 370, its implications and the situation in our country after its abrogation on August 5th, 2019 by the BJP Government.

It implies that the special status so far given to the state of J&K has been abolished and all Indians are equal, under the same nationality and common laws.

Before speaking any further, I would like to give a brief background of the Article.

In 1947 when the British were leaving India, they gave freedom to all kings to live wherever they wished to. However, with the efforts of VallabhBhai Patel, the unification was successful excepting the province of J&K.

It did not want to get merged and wanted to maintain their independent status. When Pakistan wanted to acquire Kashmir forcefully in 1947, Hari Singh the then ruler of Kashmir sought India’s help for fighting the Pakistani Army. Kashmir then became a part of India; however, special status was given to them under Article 370 and 35A for maintaining their separate status.

Under the Article, the people of J&K had dual citizenship of J&K as well as India’s. They had their separate Flag and elections were held after every six years. Criticising the Indian Flag was not an offence in the state, and the rules of the Supreme Court were not applicable.

The RTI act was not applicable in the state along with any other reservations of a minority. If a Kashmiri girl married any non-resident of Kashmir, then she would lose her citizenship; however, if married to a Pakistani, the man would also get a Kashmiri citizenship. Thus, the Article provided and secured some very important privileges of the state.

Thus, there has been a huge criticism of the abrogation of the Article by a large section of the population. Mass protests have been organised in the country; in fact, the Government has been criticised on an international level for its decision regarding the state. It is considered as a breach of human rights.

Many leaders of the state were under house arrests, telephone and internet services had been revoked, the state was under curfew for several days the situation is still the same with few changes in the recent past. For almost more than four months, Kashmir was fully cut off from the rest of the world.

In conclusion, I would like to say that revocation has had a lot of positive as well as negative results. It did have benefits for the minorities and women of the state, along with more career opportunities to the youth.

However, the picture post revocation was very grim and disheartening due to the way it took place, and the stringent actions taken by the Government worsened the situation.

Article 370 scrapped in Jammu and Kashmir - Full text of Amit Shah's speech

Union Home Minister Amit Shah on Monday proposed to scrap Article 370 of the Constitution which gives special status to Jammu and Kashmir and said the state will be split into two Union Territories: Jammu and Kashmir with an Assembly and Ladakh without one.

Making a historic announcement in the Rajya Sabha that triggered bedlam, Shah said: "I am presenting the resolution to revoke Article 370 in Jammu and Kashmir except the first clause 370 (1)."

Following his speech amid opposition protests, at times drowning his voice, the House was adjourned. It later resumed business.

In a separate statement, Shah said the government has proposed to reorganize Jammu and Kashmir carving out two separate Union Territories of Ladakh and Jammu and Kashmir.

He said this had been done in view of constant threats of cross border terrorism.

"There has been a long pending demand of the people to give it the status of a Union Territory to enable them to realize their aspirations," the statement said.

"Further, keeping in view the prevailing internal security situation, fuelled by cross-border terrorism in the existing state of Jammu and Kashmir, a separate Union Territory for Jammu and Kashmir is being created," he said.

Shah's announcement came after days of escalating tension in Jammu and Kashmir, particularly the Kashmir Valley, where panicky residents have been buying up essential goods amid a security build up.

Also in the Rajya Sabha, Shah -- whose BJP had made scrapping Article 370 an election pledge -- denied that it was 370 which linked Jammu and Kashmir with India.

"Opposition leaders are saying that Article 370 brought Jammu and Kashmir to India. But the fact is that the Maharaja Hari Singh signed on October 27, 1947 (the Instrument of Accession) while Article 370 came into existence in 1949.

"So this is wrong to say that Article 370 brought Jammu and Kashmir with India," the Minister told the Rajya Sabha in response to Congress leader and former Chief Minister Ghulam Nabi Azad who condemned the decision to axe Article 370.

Leader of Opposition Azad said: "By revoking Article 370 that accords special status to Jammu and Kashmir, the BJP government has murdered the Constitution of India." 

He underlined that it was the historic Article 370 which linked Jammu and Kashmir to India. 

Shah said Article 370 was used as "vote bank politics" and that earlier governments lacked the political will to revoke it.

"But the Modi government has the political will and we are not bothered about vote bank politics." 

He asked the opposition members to have a debate on the resolution and said there should not be a delay "even one second" in revoking Article 370.

In Parliament, two members of the Peoples Democratic Party (PDP), Nazeer Ahmed Laway and Mir Mohammad Fayaz, were told to leave the House after they tore up copies of the Constitution.

But besides the treasury benches, the BJP won the support of the Bahujan Samaj Party (BSP), Biju Janata Dal (BJD), Telugu Desam Party (TDP) and YSR Congress supported the government move.

On Sunday night, the Jammu and Kashmir government-imposed restrictions under Section 144 of the CrPC in Srinagar district and placed the top leadership of the state, including former Chief Minister Omar Abdullah and Mehbooba Mufti, under house arrest.

Internet services were shut down in several parts of the Valley and educational institutions were ordered closed. Earlier, tourists were asked to leave Jammu and Kashmir while the Amarnath Yatra was curtailed.

National Conference leader Omar Abdullah called the decision "a betrayal of people's trust" and amounted to "aggression". 

PDP leader Mehbooba Mufti dubbed the decision to scrap Article 370 as "the darkest day in Indian democracy".

"Decision of J&K leadership to reject 2 nation theory in 1947 & align with India has backfired. Unilateral decision of GOI to scrap Article 370 is illegal & unconstitutional which will make India an occupational force in J&K," she tweeted.

"It will have catastrophic consequences for the subcontinent."
