How 911 sent me code 3 to law school.

Imagine this: It’s 4 am and you’re working as an EMT running 911 calls. Dispatch notifies you that you need to respond to a call… now! You turn on the lights and sirens, also known as Code 3, and make your way to the call. You show up. It’s chaotic and you grab the gurney, nitroglycerin, and oxygen tubing amongst others. You save the patient, and everyone is happy. You clean the ambulance and sit down for a moment to relax. But dispatch rings and you’re off again.

While working as an EMT, I was exposed to numerous medications and medical devices. It wasn’t until my first semester at Loyola University Chicago School of Law that I realized so many features of the ambulance and almost all of the medications and devices I used, including those stated above, had one thing in common: they were Intellectual Property (IP).

Being Dispatched (to Law School) Initially, I was working as an EMT to fulfill a requirement to help me get into medical school. However, in working 911, I was confronted with the many rules and procedures that I found ineffective in providing health care to someone. I realized that I was more interested in reforming the governing law of healthcare systems than I was in being a medical provider.

Arriving on Scene (to IP at Loyola) The summer before starting my first year at Loyola, the school sent out an application for a legal writing class focusing on IP topics. I thought “if I’m going to have to write, might as well try an area I don’t know much about.”

After running a quick Google search, I discovered IP was present in so much of my life and I wanted to learn more about it. For instance: the Nike logo is trademarked , the iPhone is patented , and almost all songs on the radio are copyrighted ! While I was swaying away from studying health law, there were so many overlaps with IP, and I wanted to broaden my knowledge of law.

I further immersed myself in the IP world by signing up to be a member of the Intellectual Property Law Society (IPLS), a club that exposes students to IP and provides opportunities to learn about careers in IP. In my first semester in IPLS, I attended a multitude of IP networking events with attorneys. For example, there was a speed networking event and a panel discussing the different sectors of IP (trademark, copyright, patents, and trade secrets ). I loved talking with the panel, networking, and learning about the IP field.

I am currently enrolled in an elective class, Global Access to Medicine: A Patent Perspective. (Yes, you get to take an elective class as a 1L at Loyola!) The topics in this class are vast. This class focuses on pharmaceutical drugs, including the drugs I used to administer to patients, and international agreements between countries. I never thought I would get to experience an interdisciplinary approach to legal issues like this in the classroom. I love being able to tie in my past with my present and learn about the connecting world of law and medicine as well as IP and international law. (Let’s just hope I don’t have to pronounce any of the medication names!)

Staying on Scene (and Building a Career) At one point, I did not think going to law school was a possibility. But as I know from 911 calls, things can change very quickly. I came to law school with an interest different than what it is now. I am so excited to learn more about the IP opportunities available to me! I can’t wait to see what else I can discover while at Loyola. When it’s my time to retire I’ll leave the scene of law. But for now, I’m going to stay on scene and learn as much as I can.

There’s a new law stopping squatters in Florida. 5 things to know

Gov. Ron DeSantis signed the  "Property Rights" bill ( HB 621) , which seeks to provide homeowners remedies against squatting and increases penalties on squatters.

“We are putting an end to the squatters scam in Florida ,” DeSantis said in an announcement . “While other states are siding with the squatters, we are protecting property owners and punishing criminals looking to game the system.”

Prior Democrat reports shared DeSantis used the bill's signing to criticize liberal states again and compare them to Florida, which he has called the "law and order" state.

"What passes muster in New York and California is not passing muster here," he said. "You are not going to be able to commandeer somebody's private property and expect to get away with it. We are, in the state of Florida, ending the squatter scam once and for all."

What is HB 621?

House Bill 621 authorizes property owners to request action by the sheriff's office to immediately remove unauthorized persons from your home, according to the bill analysis.

With a form, it will allow sheriff's offices to charge an hourly fee if the property owner requests their assistance "to keep the peace while the property owner or agent of the owner changes the locks and removes the personal property of the unlawful occupants from the premises to or near the property line."

What are squatter rights?

Squatting is defined as when someone who occupies a property without the owner's consent. They may live in abandoned buildings, vacant land or even in someone's home, making it legally contentious and logistically contentious to kick them out.

Squatters rights usually provide that a person has the legal right to live in a place they have lived in for an extended amount of time, provided the owner does not take legal action, according to the  American Apartment Owners Association.  That time ranges from five to 30 years.

But many of the illegal "squatting" incidents making headlines recently have occurred in the short-term, where people claimed tenant rights laws to require property owners to go through a lengthy eviction process to remove someone and stay for free in the meantime,  Newsweek reported .

Every state has squatters rights, but when and how these laws are enforced varies state by state.

When does HB 621 go into effect?

HB 621 will go into effect on Monday, July 1 of this year.

What are the penalties for those who violate HB 621?

According the bill analysis, it will create criminal penalties for violators, including:

  • A first-degree misdemeanor for making a false statement in writing to obtain real property or for knowingly and willfully presenting a falsified document conveying property rights.
  • A second-degree felony for any person who unlawfully occupies or trespasses in a residential dwelling and who intentionally causes $1,000 or more in damages.
  • A first-degree felony for knowingly advertising the sale or rent of a residential property without legal authority or ownership.

Which states have squatter laws?

Florida is one of a few states currently considering laws to target squatters. USA TODAY tracked down other anti-squatting laws currently in the works, such as:

  • Oklahoma State Senate Bill 456  filled in 2023 sought to repeal part of property acquisition law to target squatters. The bill did not make it past the first reading.
  • New York Assembly Bill A6894  seeks to exclude squatters from tenant protections. It was originally filed in May 2023, but was touted again Wednesday by the state  Assembly GOP  in light of the NYC murder.
  • Alabama House Bill 182  was introduced earlier this year and has been placed on the calendar with amendments. It aims to give property owners more rights to remove squatters.
  • Georgia Squatter Reform Act (HB 1017)  was introduced in the current session, has passed both the state House and Senate, and is headed to the Governor's desk. It adds squatting to criminal trespassing definition.

New Florida law may force Gainesville to forbid sleeping and camping on public property

A new Gov. Ron DeSantis-backed Florida law could force Gainesville to forbid people from sleeping on public property. 

The anti-public camping bill, heralded by state Republicans and DeSantis, will prohibit municipalities from allowing camping on public property. It will instead force municipalities to provide a designated specific public space for camping along with mental health resources, bathrooms and security.

Proponents of the legislation, including DeSantis, see it as a way to ensure homeless people have the resources needed to “get back on their feet,” while creating cleaner and safer streets. Critics say the law, which goes into effect Oct. 1, unfairly targets and harms a vulnerable population.

“We have decades of evidence that shows that tickets and jails don't do anything to get people off of the street,” said Jon DeCarmine, executive director of Grace Marketplace. “I don't expect this bill to have any positive impact on vulnerable people who are on the streets. To the contrary, it is very likely to make both their lives more difficult and life more difficult for the communities that are now trying to interpret this law in some way.”

In February Gainesville officials largely cleared out a homeless encampment on Southeast Fourth Place, tagging peoples’ belongings with notices that they needed to move from public right-of-ways or their property would be removed by city staff.

At the time, city staff was able to ask people to move from sidewalks and roads, but not other public areas. This new law, however, would have forced them to do so.

In response to concerns over the growing encampment, commissioners also voted to allocate $700,000 to help curb homelessness in the city. The money has gone toward creating 10 new shelter beds at Grace Marketplace, with 10 more being created in the coming months.

“The issue that pops up most often is when people can't or won't come into shelter,” DeCarmine said. “Then we need to start looking at other arrangements like street outreach services, direct housing placements, or any other opportunities to get somebody off the street and into housing.”

Gainesville Mayor Harvey Ward said it is still unclear what exactly this new law will mean for the city. He pointed out that the U.S. Supreme Court has taken up a case from Oregon and will rule on whether a local government can make it illegal to sleep outside when adequate alternative shelter is not available.

Florida’s law, notably, will not ticket unhoused people, but rather the municipalities for allowing them to sleep in undesignated public areas.

“I don't want to make guesses at what the court is likely to do and exactly how that will work with this new law. Like many of the things that we've seen come through the Florida Legislature over the last two years, it's not particularly clear,” Ward said. “It makes some broad assumptions and some broad requirements but leaves a lot up in the air.”

Some points of uncertainty Ward pointed out are the extent to which the county will be involved, and the fact that these designated camping sites will not allow drugs or alcohol despite the prevalence of them among chronically unhoused people with mental health conditions.

He said he hopes to get clarity soon on the questions he finds unanswered in the law.

“I hope to actually speak with the representative who brought it forward because I don't think anybody had ill intent with this, I'm not starting from that position,” Ward said. “I think that they probably just didn't coordinate with first responders who had experience in these areas and with local lawmakers who had experience in these areas, because if they had, they would have written this bill differently.”
